Terms of Service
Last updated: October 23, 2026
1. Acceptance of These Terms
These Terms of Service ("Terms") are a legal agreement between you and VITA AI ("VITA," "we," "us," or "our"). They govern your access to and use of the VITA website, web app, virtual desktop, AI coworker, and related services (collectively, the "Service").
By creating an account, accessing the Service, or clicking to accept these Terms, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and the organization.
You are responsible for:
- Providing accurate account information and keeping it up to date.
- Keeping your email account and sign-in links secure.
- All activity that occurs under your account, including activity by members of your organization.
- Ensuring that anyone you invite to your organization follows these Terms.
We use magic-link emails to sign you in. If you believe someone has gained unauthorized access to your account, contact us immediately at [email protected].
3. The Service
VITA is an AI coworker that operates a cloud-hosted virtual desktop. You can ask it to browse the web, create content, manage files, connect to social platforms, schedule tasks, and perform other actions you request.
VITA is currently in public beta. Features may change, be added, or be removed, and the Service may contain bugs or interruptions. We do not guarantee that any particular feature will remain available.
You are responsible for the instructions you give VITA and for reviewing its work. VITA may take actions you did not anticipate if your instructions are ambiguous. Use the review and confirmation features available in the Service, and do not rely on VITA to complete important work without human oversight.
4. AI Output and Your Responsibilities
VITA uses third-party AI models and tools. AI output is probabilistic and may be inaccurate, incomplete, biased, or unsuitable for your purpose. You are responsible for evaluating and verifying all output before you use or publish it.
You acknowledge that:
- VITA is not a substitute for professional legal, medical, financial, or other advice.
- You must not use VITA for decisions that have legal or similarly significant effects on a person without meaningful human review.
- You are responsible for ensuring that content you publish is accurate, lawful, and compliant with the rules of the platform where it appears.
- VITA may use browser automation on its virtual desktop when a direct integration is not available. You are responsible for making sure that use complies with the relevant platform's terms.
5. Your Content and Ownership
You retain ownership of the content you submit to the Service, and, as between you and VITA, you own the output VITA generates for you, to the extent permitted by law and the terms of the underlying AI providers.
To operate the Service, you grant VITA a non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, display, process, and create derivative works of your content as necessary to provide, maintain, and improve the Service. This license also permits us to share your content with the service providers described in our Privacy Policy and with social platforms when you ask us to publish.
You represent and warrant that:
- You have all rights and permissions needed to submit your content.
- Your content does not infringe anyone's intellectual property, privacy, or other rights.
- Your content and your use of the Service comply with applicable law.
We may remove content that violates these Terms or applicable law.
If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation. Your feedback is not confidential.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Violate any law, regulation, or third-party right.
- Post or distribute illegal content, including content that infringes copyright, promotes hate or violence, harasses others, or sexually exploits minors.
- Engage in fraud, phishing, scams, or deceptive practices.
- Send spam, bulk unsolicited messages, or engage in fake engagement, platform manipulation, or any activity that violates the rules of a connected social platform.
- Impersonate another person or entity without authorization, or create misleading deepfakes or deceptive endorsements.
- Collect, disclose, or use another person's personal information without a lawful basis, including doxxing or unauthorized scraping.
- Upload malware, attempt to gain unauthorized access to the Service or another system, probe or scan our infrastructure, or interfere with the Service's security or performance.
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except where the law expressly permits it.
- Circumvent usage limits, credits, rate limits, or access controls, or resell or provide the Service to third parties without our written permission.
- Use the Service for automated decisions in high-stakes areas such as employment, credit, housing, insurance, healthcare, or law enforcement without meaningful human review.
- Submit sensitive personal information, such as government identification numbers, financial account numbers, or health information, unless it is necessary for the task and you have the right to do so.
We may investigate suspected violations and cooperate with law enforcement.
7. Connected Accounts and Third-Party Platforms
You can connect third-party accounts, including social media accounts, to VITA. By connecting an account, you authorize VITA to access and use that account within the permissions you grant, including preparing, scheduling, and publishing content on your behalf.
You represent that you have authority to connect each account and that your use of the account complies with the platform's terms. Third-party platforms are not controlled by VITA. They may change their APIs, limit access, or suspend your account, and we are not responsible for those actions. Your use of a platform is governed by its own terms and privacy policy.
You can disconnect an integration at any time from the Integrations page. Disconnecting an integration cancels pending scheduled posts associated with it. You can also revoke access from the platform's own settings.
8. Plans, Credits, and Billing
Free tier
We offer a free tier with daily usage limits and access to basic AI models. We may change free-tier limits or features at any time.
Paid plans and credits
Paid plans include a credit allowance that is consumed as VITA performs work. Credits are a usage measure, not money or stored value. Credits are non-transferable, have no cash value, and expire at the end of the applicable billing period, except for purchased top-up credits that are described as persisting across periods. If you run out of credits, tasks may be blocked until your allowance renews or you purchase a top-up.
We may change plan features, credit allowances, and prices. We will give reasonable notice of price changes, and changes will apply at your next renewal unless the law requires otherwise.
Payments and renewals
Payments are processed by Lemon Squeezy, our merchant of record. By purchasing a paid plan, you authorize us and Lemon Squeezy to charge your payment method on a recurring basis until you cancel. Fees are stated in US dollars and exclude taxes unless stated otherwise. You are responsible for applicable taxes, except where Lemon Squeezy collects and remits them.
Your subscription renews automatically for the same billing period unless you cancel before the renewal date. You can cancel, pause, or manage your subscription from the billing settings in the Service or through Lemon Squeezy's customer portal. If you cancel, you will retain access through the end of your current paid period; we do not provide prorated refunds for partial periods.
Except where required by law or expressly stated at checkout, payments are non-refundable, including unused credits. If you believe you were charged in error, contact us at [email protected].
Organization billing
If you purchase a plan for an organization, the organization's owner and authorized billing administrators may manage the subscription. You are responsible for ensuring that you have authority to make purchases on behalf of the organization.
9. Privacy
Our Privacy Policy explains how we collect, use, and protect personal information. It is incorporated into these Terms by reference.
10. Suspension and Termination
You may stop using the Service at any time. To request deletion of your account, contact us at [email protected].
We may suspend or terminate your access to the Service if:
- You materially breach these Terms.
- Your use creates a security, legal, or operational risk.
- We are required to do so by law.
- Your subscription is unpaid or expired.
Where reasonable, we will give you notice and an opportunity to resolve the issue. We may act immediately if the violation is serious or poses a risk to others.
On termination, your right to use the Service ends. We may delete your data in accordance with our Privacy Policy. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and governing law — will survive.
11. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, VITA disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not warrant that:
- The Service will be available at all times or free of bugs.
- AI output will be accurate, complete, or suitable for your purpose.
- Content published through a connected platform will remain available or will not be removed by that platform.
- Your workspace files will never be lost. You should keep independent backups of important content.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
12. Limitation of Liability
To the maximum extent permitted by law, VITA and its officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Service.
Our total liability for all claims arising out of or related to the Service will not exceed the greater of (a) US$100 or (b) the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or intentional misconduct.
13. Indemnification
You agree to defend, indemnify, and hold harmless VITA and its officers, employees, contractors, and service providers from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of:
- Your content or the content VITA publishes at your direction.
- Your connected accounts or your use of a third-party platform.
- Your breach of these Terms or applicable law.
- Your violation of another person's rights.
14. Copyright Complaints
If you believe content on the Service infringes your copyright, contact us at [email protected] with:
- A description of the copyrighted work.
- The location of the allegedly infringing content.
- Your contact information.
- A statement that you have a good-faith belief the use is unauthorized.
- A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.
We may remove content and terminate accounts that repeatedly infringe copyrights.
15. Governing Law and Disputes
These Terms are governed by the laws applicable to the VITA AI entity that provides the Service, without regard to conflict-of-laws rules. Any dispute will be brought in the courts of that jurisdiction, unless mandatory law gives you the right to bring a claim elsewhere.
Nothing in these Terms limits any consumer rights or data protection rights you have under mandatory local law.
16. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and change the "Last updated" date above. If a change is material, we will provide reasonable notice by email or in the Service. Your continued use of the Service after the update means you accept the revised Terms.
17. General
These Terms and our Privacy Policy are the entire agreement between you and VITA regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. We are not responsible for delays or failures caused by events beyond our reasonable control.
